Bauchi — The Bauchi State Upper Shari’ah Court has sentenced a 30-year-old man, Umar Mohammed Kandahar to death by stoning for impregnating his younger sister.
But Daily Trust gathered that the convict has appealed the judgment at the Shariah Court of Appeal.
From the court records made available to newsmen in Bauchi, Umar was arraigned before the Upper Sharia Court, Unguwar Jaki, by the Bauchi State Shari’ah Commission for impregnating his younger sister.
Counsel to the Shariah Commission Barrister Dayyabu Ayuba told the court that the suspect, who has three wives forcefully slept with his younger sister. It was gathered that the girl was 16-years-old when the incident occurred. The offence is contrary to Section 136(1) of the Bauchi State Penal Code.
The accused pleaded guilty to the charge, but denied the allegation that he forcefully slept with the victim. He maintained that the sexual intercourse was consensual.
The judge, Musa Barde then sentenced Umar to death by stoning.
In his appeal, the convict said he does not agree with the judgement. Counsel to Umar, Barrister Sadiq Abubakar filed a motion before the Bauchi State High Court yesterday asking for the bail of the accused pending the determination of his appeal by the Sharia Court of Appeal.
He told the court that the accused family has been suffering because of his detention which commenced in 2011.
The judge, Aliyu Baba Usman has fixed Monday November 25, 2013 for continuation of hearing on the bail application.
