I’ll challenge decision on my impeachment in S’Court -Bauchi ex-dep gov

A former deputy governor of Bauchi State, Alhaji Muhammadu Garba Gadi, has said he will appeal the recent judgment of the Court of Appeal, Jos Division, which upheld his impeachment in 2010 by the state House of Assembly.

The Appeal Court, on July 26, 2013, set aside the judgment of the Bauchi State High Court which reinstated Gadi, who was elected alongside Governor Isa Yuguda in 2007, and asked him to pay the sum of N30,000 to the appellants in the case.

The judgment, in the suit CA/J/269/2010, presided over by Justices Oyebisi Folayemi, Ibrahim Shata Boliya and Peter Olabisi Ige, followed the appeal against the judgment of the Bauchi State High Court delivered on June 25, 2010, which declared the removal of the erstwhile deputy governor unconstitutional, null and void.

He was removed by the state House of Assembly, following the report of a seven-man investigative panel set up by the state chief judge to investigate some allegations levelled against him.

The panel, among other allegations, found him guilty of financial impropriety, Speaking to journalists in Bauchi, in a telephone interview at the weekend, counsel for the former deputy governor, Abubakar Malami, said the defence team was compiling its papers with a view to appealing the decision of the appellate court at the Supreme Court.

“We have three months to appeal to the Supreme Court. We are compiling our papers and facts and I can assure you that insha Allah, we will file an appeal against the judgment in order to get justice,” he said.
