A chief magistrates’ court in Bauchi State, on Wednesday, ordered the chairman of Bauchi State Universal Basic Education Board (SUBEB), Alhaji Abdullahi Dabo, to appear physically before it on June 4, to answer criminal charges pressed against him.

Delivering her ruling on the preliminary objection  raised by the chairman’s counsel, Mr Saleh Bakaro, challenging the jurisdiction of the court to entertain the matter, saying it was not necessary  for his client to be in court since he was being represented by a lawyer, the principal magistrate, Shafa’u Ladan Yusuf, overruled the objection of the defence counsel, adding that the SUBEB chairman must appear in court the next adjourned date for his plea to be taken.

“This is the position of the law,” she ruled.

The chairman was dragged before the court by one Mohammed Bawa, through his counsel, Jibrin Sa’ad Jibrin, asking the court to investigate four criminal charges of assault, criminal  force, beating and hurt, which he said were contrary to sections 244 and 265 of the Penal Code.

He also asked the court to compel Dabo to appear in court in person for the trial.

Commenting on the ruling, Dabo’s counsel expressed dissatisfaction with the ruling, saying the presiding judge did not address the point the defence raised in its application. He said he would appeal the decision before the  Bauchi High Court.

The plaintiff’s counsel, however, said he was satisfied with the decision.
