Bauchi Sues Pry School Teacher for Child Rape

Bauchi State Ministry of Justice has sued a Primary School Teacher, Mr. James Dantayi, for allegedly raping a nine-year-old girl, Hauwa’u Ahmed, in his office; just as the Bauchi State Upper Shariah Court yesterday discharged and acquitted two suspects, Usman Sabo and Hafizu Abubakar, arraigned over alleged homosexual activities.

The case of rape between the State Vs Dantayi was filed before Bauchi State High Court Number Seven Presided over by Justice Aliyu Baba Usman.

Prosecution Counsel Rukayyatu Ikewar told the court that the accused had a forceful carnal knowledge of a girl in his office, in which she sustained injuries and immediately she was taken to hospital for treatment, contrary to section 283 of the Penal Code. The accused denied the charges.

When the case was mentioned, counsel to the accused, Obadia Buchi, observed that the name of the second prosecution witness was not submitted to court due to oversight and sought for adjournment to enable them put their house in order. Justice Usman granted the application and adjourned the case for continuous hearing. Meanwhile, a Bauchi State Upper Shariah Court has discharged and acquitted two suspects Sabo and Abubakar, arraigned over alleged homosexual activities.

In his judgment, the Presiding Sharia Court Judge, Aliyu Elyaqub, said they were discharged over inability of the prosecution counsel from Bauchi State Commission to prove his case with genuine evidence. Aliyu said since there was no witness that saw the accused committing the alleged offence and the accused pleaded not guilty they were discharged under section 28 of the criminal procedure court of Bauchi State Sharia law 2001.

The Commissioner of Bauchi State Hisbah, Alhaji Jibrin Danlami Hassan, said the commission has done its best in their effort to sanitise the society and to ensure justice for all. Hassan said the commission would meet to study the judgment.
