Bauchi State House of Assembly appeals court order to reinstate suspended …

The Bauchi State House of Assembly has appealed the court order for the immediate reinstatement of Hon.Rifakatu Samson Dannah who was said to have been illegally suspended, following her position over the relocation of Tafawa-Balewa Local Government Council headquarters to Bununu.

It would be recalled that on the 30th May, 2013, the High court presided over by the State Chief Judge, Justice Ibrahim Zango, ordered the State Assembly to re-instate the suspended law-maker in line with the 1999 constitution as amended in section 109, 110, stating that as a lawmaker, she had the right to support or kick against matters at the floor of the House.

According to the judgment, the suspension of the only female legislature was not only arbitrary, but, illegal and unconstitutional to the rule of law.

Meanwhile, the House, according to the notice of the appeal made available to newsmen seeks for an order staying execution of the judgment of the lower court, pending hearing and determination of the appeal by the court of appeal in Jos.

The House had also disagreed over the ruling of the lower court when the judge held that the embattled law-maker was denied fair hearing which contravenes section 35 of the 1999 constitution as amended.

It further expressed dismay that the embattled lawmaker admitted using offensive language on the appellants, yet the judge held that she was denied fair hearing.

The appeal which was made available through the house, Speaker’s Counsel, Mahmood Haruna Yakubu demands the court of appeal to set aside the decision of the Bauchi State High court delivered on 30th May, 2013 in a suit No. BA/45M/13.

Reacting to the development, Mallam Sakis who is the leader of the opposition parties in the State, described the house members as illiterates who lack internal democracy.

He challenged them to maintain the rule of law, saying “we are in a democratic dispensation not military rule”

He called on the electorates to always use wisdom when choosing their leaders.
