Appeal Court upholds impeachment of ex-Bauchi dep gov

THE Court of Appeal, Jos, has set aside the judgement of the Bauchi State High Court, which reinstated the erstwhile deputy governor of the state, Alhaji Muhammad Garba Gadi, asking him to pay the sum of N30, 000 as cost to the appellants in the case.

The judgement of the Appeal Court in the suit CA/J/269/2010, presided over by Justices Oyebisi Folayemi, Ibrahim Shata Boliya and Peter Olabisi Ige, was delivered on Friday, July 26, followed the appeal against the judgment of the Bauchi State High Court delivered on June 25, 2010 which declared the removal of Gadi as the state’s then deputy governor as unconstitutional, null and void.

Gadi had been removed by the state House of Assembly, following the report of a seven-man panel set up by the assembly to investigate some allegations levelled against him. The panel had found him guilty of financial impropriety, among other allegations.

Dissatisfied with his impeachment, Gadi headed for the state high court, which declared his impeachment unconstitutional, null and void. This, the assembly, alongside 14 others, including state governor, the Speaker and state Chief Judge, appealed against in the appeal court.

The appeal court judgement, copies of which were made available to newsmen in Bauchi, on Tuesday, by the Chief Press Secretary (CPS) to Governor Isa Yuguda, Mr Ishola Michael Adeyemi, read in part: “Three issues were placed before the Court of Appeal. All three issues were resolved in favour of the appellants, in order words, the appeal succeeded.”

The Court of Appeal also stated that “the judgement of the Bauchi State High Court, delivered on the 25th day of June 2010 is, hereby, set aside. Respondent, Alhaji Garba Gadi, shall pay costs of N30, 000 in favour of the appellants.”

With the Court of Appeal’s decision, all the orders made by the state High Court at the end of the trial in Bauchi have been set aside, while the seven-man panel and the process of the removal of Alhaji Gadi have been declared to be valid, proper and lawful.
